Mental capacity means being able to make your own decisions and understanding the impact they may have. No one can make choices on your behalf unless it’s clear that you’re unable to do so yourself.
What does this mean?
If you’re thought to lack mental capacity for a particular decision, it means you may find it difficult to:
- Understand the information needed to make that decision.
- Weigh up the pros and cons to reach a choice.
- Remember the information long enough to make a decision.
- Communicate your decision, whether through words, sign language, or other methods.
It’s important to remember that mental capacity can vary depending on the situation. You might be able to make decisions about certain things but not others, or sometimes you may be able to make a decision at one point but not at another. This is why anyone considering your mental capacity must look at your ability to make a specific decision at the time it’s needed.
You should always be supported as much as possible to help you make and express your own choices before anyone assumes you can’t.
Taking your time to think things through or needing help to communicate doesn’t mean you lack mental capacity. And having a condition like dementia doesn’t automatically mean you can’t make decisions—many people continue to have the capacity to decide on certain matters even after a diagnosis.
