Enduring Powers of Attorney

An Enduring Power of Attorney is a legal document that allows you to appoint someone you trust to manage your financial and property affairs if you become unable to do so yourself. While they can no longer be made, existing ones remain valid.

Replaced by Lasting Powers of Attorney

In October 2007, Enduring Powers of Attorney (EPA) were replaced by Lasting Powers of Attorney. However, many Enduring Powers of Attorney created before this date are still valid.

We recommend you check the following:

  • The date  the EPA was created.
  • Whether the attorneys named are still appropriate and able to act on your behalf.

If you find the EPA was created after October 2007 or the attorneys are no longer suitable, consider calling us to create a new Lasting Power of Attorney to ensure your preferences are up-to-date and legally recognised.

Guidance for Appointed Attorneys in an Enduring Power of Attorney

If you are named as an attorney in an EPA and the person who appointed you is becoming unable to manage their affairs, you will need to register the EPA with the Office of the Public Guardian.

Here’s what you should do:

  1. Apply for Registration: Submit an application to the Office of the Public Guardian to register the EPA. This step is necessary for the EPA to be legally effective.
